2nd.- Identification

These General Terms and Conditions of Contract (hereinafter "Terms") are intended to regulate the relationship between SEIP S.C.P. (hereinafter the "Provider") and the customers (hereinafter the "User"), relating to all transactions carried out through the online store website.

The term "user" or "client" refers to the internet user who acquires this status by registering on the website using a form and being assigned a username and password, for which they are fully responsible for use and safekeeping, and are responsible for the accuracy of the personal data provided to the provider, as we will see in the User Registration section.

3rd.- Acceptance

By accepting these Terms and Conditions, the User declares:

1. That is a person with the capacity to contract according to current regulations.

2. That you have read and accept these Terms and Conditions.

4th.- Availability

The User will always have access, prior to the start of the product contracting procedure, to the conditions, which may be stored and/or reproduced on a durable medium.

5th.- Validity or Duration

The validity period or duration of these Terms and Conditions and specific contracting conditions will be the time that they remain published on the aforementioned website and will apply from the moment the User makes use of the website, and/or proceeds to contract any products.

6th.- Modifications

The provider reserves the right to unilaterally modify these Conditions, without this affecting the goods or promotions that were acquired prior to the modification by the User.

The User agrees to carefully read the terms and conditions of purchase each time they purchase a product, as these may have been modified since their last visit.

7th.- Nullity

If any clause included in these Terms is declared wholly or partially null or ineffective, such nullity will only affect that provision or the part thereof that is null or ineffective, the Terms remaining in full force and effect in all other respects.

8th.- Object of the contract

The purpose of this contract is to regulate the contractual relationship of sale and purchase created between the provider and the user at the moment when the latter accepts the purchase during the online contracting process through the mechanisms set out below.

The contractual relationship of purchase and sale involves the delivery, in exchange for a price that is determined and publicly displayed through the website, of one or more specific products.

Each of these products may be subject to specific regulations through the particular contracting conditions of each one, which will be given more details in the section on guarantee, returns, withdrawal, or in the product's own technical data sheet, due to the different formats in which the products are marketed, their packaging or their own nature.

14.1.- Registration

If you choose to register beforehand, click the "User Icon" button in the upper right corner, then "Don't have an account? Create one here," and fill in the required information on the page that appears.

The registration system does not include a user verification process. Therefore, before user activation, a welcome message is sent to the user's email address. Once successfully registered, the user can log in with their username and password to their profile control panel to manage all the features provided by the website provider, such as account details, delivery addresses, order history, discount coupons, alerts, etc.

Once you have registered, you can proceed to purchase your product(s).

If you can't find what you're looking for on our website, please don't hesitate to ask. We manufacture custom-made products directly from the factory, both domestically and internationally.

17th.- Maximum order amount

There is no maximum order.

18º.- How to extend or cancel my order

To add items to an order, you can do so as long as you haven't completed the purchase. You can do this by returning to the store page and adding new products to your cart.

To cancel an order after making a purchase, it can be cancelled with the right to a full refund as long as the order does not involve product customization and has not left our warehouses or is in transit to the indicated address.

For orders that do not involve personalized products and have already left our facilities, the courier company will be notified and in this case, the refund amount to the customer would be in full except for the shipping costs.

To request a cancellation, you must contact our customer service department immediately.

19. Shipping costs, methods, and delivery time

Shipping costs will be based on the following rates:

- Free shipping for orders to mainland Spain whose value exceeds the amount of

€200 (VAT not included)

- For standard orders with a value less than €200, a

20th.- The delivery time

Delivery times for an order are variable and estimated. They are specified during the purchase process.

For orders that do not include personalized products, the delivery time is typically between 2 and 5 business days, starting from the moment the order is confirmed as successfully placed. However, for orders that do include personalization, the delivery time may be 7, 15, or even 30 business days.

If you do not receive your package within the stated timeframe, an investigation will be conducted with the carrier, which may take several days (approximately fourteen (14) business days). During this period, no reshipment or refund of your order will be possible.

We advise you to check that everything matches your order upon receiving your package and that the packaging is in perfect condition. Then, sign with reservations and note by hand on the carrier's delivery slip if you find any discrepancies. If, upon opening your package, you find that the delivered items do not match your order or are damaged, please contact our Customer Service department (see section below).

21st.- Invoice

Where can I find my invoice? The invoice is sent electronically, via email.

22nd.- Value Added Tax

In accordance with current regulations, all purchases made through the website will be subject to Value Added Tax (VAT).

23º.- Payment methods or modalities

In general, the User may choose the payment method:

A) By credit/debit card, for which it will provide, among other things:

(i) name and surnames;

(ii) card number;

(iii) CVV/CVC;

(iv) card expiry date;

Once you have validated all the information about your purchase (items, shipping methods, delivery and billing address), a choice will appear to select which payment method you wish to use and enter your details.

If the payment platform reports that the card has been declined, the order will be automatically canceled, and the customer will be notified online immediately, as previously mentioned. Payments cannot be made with cards issued outside of Spain.

B) By bank transfer

You will need to make the transfer to the account that will be indicated to you in due course.

IMPORTANT: As the transfer concept, you must only indicate the order number that will be provided to you.

CASH ON DELIVERY IS NOT ACCEPTED

Your card details will not be stored in our database, as they will be entered on the secure website of the chosen bank.

24th.- General provisions on the Payment Process

• The payment order given by the User necessarily implies adherence to these General Conditions as well as the particular conditions of the order.

• For any form of payment chosen by the User, all payments will be subject to the terms and conditions applicable to the User by the intervening financial entities or by the secure payment platforms (p.e. Visa, Mastercard, etc.).

• Once the payment has been successfully processed, the User will receive two informational and confirmation emails that verify the essential conditions of the transaction:

  • Payment confirmation.
  • Order confirmation; summary of purchased products; prices; shipping and billing address.

The order confirmation email will contain the product invoice.

The Provider reserves the right to cancel payments or orders in the event of any indications of fraudulent transactions, reporting to the competent authorities any conduct that may be subject to investigation for the prevention of fraud.

25.- Returns of defective, damaged or incorrect products or exercising the right of withdrawal

Once you have received your order, you can cancel your purchase, provided that the product has not been used, has its original packaging, or one that guarantees that the product will not suffer damage, as well as all its original accessories or promotional gifts, if any, within 14 calendar days after receiving your order.

Please note that when you exercise your right of withdrawal, you will receive a full refund for the product(s) purchased, including the purchase price and, if applicable, the standard delivery costs. If you choose to have the product collected from your home, the collection costs will be your responsibility.

Personalized items cannot be returned.

In the case of products that require opening and use to determine if they function properly, the Provider will require, in order to accept the return, that the returned product is in perfect condition and must also ensure that: it has not been used incorrectly or negligently, handled improperly or recklessly, or subjected to abnormal or harmful conditions; it has not been involved in any accident or damaged while attempting to repair or modify it; it has not been used contrary to the manufacturer's instructions; and it has not deteriorated due to natural wear and tear after receipt.

If the product does not meet any of the aforementioned requirements, we may, at our discretion, decide not to repair or replace the product, nor refund the amount paid, and/or we may request that you reimburse all shipping and inspection costs incurred, according to current standard rates. To process this reimbursement, we may charge the aforementioned costs to your credit or debit card account or use the payment details provided when placing the order.

In cases where you believe that at the time of delivery the product does not conform to the stipulations of the Contract, is a product damaged during its shipment, or is incorrect, you must contact us immediately.

The full amount paid for any products returned due to a proven fault or defect will be refunded, including the original delivery charges. The refund will be issued to the same payment method used for the purchase.

Rights recognized by current legislation remain unaffected.

26.- Exceptions to the right of withdrawal

The right of withdrawal does not apply to the delivery of:

a) The supply of goods made to the specifications of the consumer and user or clearly personalized.

b) The supply of goods that may deteriorate rapidly.

c) The supply of sealed goods which are not suitable for return for reasons of health protection or hygiene and which have been unsealed after delivery.

28th.- Product Guarantee

The items offered on our website have the official manufacturer's warranty under the legally established terms, for a period of 3 years from the date of delivery or for the period that is legally established at any given time.

This warranty does not cover defects caused by negligence, impacts, misuse or improper handling, nor materials that are worn out from use.

To claim your warranty, please contact Customer Service by phone or email, where they will inform you of the process to follow.

29th.- Provider's Rights

● Maintain, modify or suspend your website without prior notice.

● Modify the price of the offers.

● Reject orders due to lack of stock or customer non-payment.

● Reject access to computer tools to clients in case of non-compliance with these conditions.

● Receive payment for customer purchases once the transaction is accepted.

● Retain ownership and full title to the item until full payment is received from the customer.

● Do not reproduce, sell or dispose of the information published by the Provider in all its contents without the express permission of the company itself.

● Proceed to correct or amend human or computer errors.

30.- Limitation of liability

All information provided by the User to the Provider through the corresponding forms must be truthful. It is the User's responsibility to keep the data provided to the Provider duly updated. In any case, the Provider is exempt from any liability for damages or losses caused as a result of providing false, insufficient, inaccurate, or incorrect information.

Access to the website does not imply any obligation on the part of the Provider to verify the authenticity, suitability, completeness, accuracy, adequacy and updating of the information provided by the User through the corresponding forms.

The Provider will not be liable in cases where it is the responsibility of the parents, guardians, or legal representatives of Users who are minors or incapacitated to authorize access, the provision of personal information, or the use of the website, or the contracting of any products or services provided through the applications or web platform. It will be the responsibility of said parents, guardians, or legal representatives to supervise the minor's or incapacitated person's access to and use of the website, as well as the contracting of products and services provided through HTTPS://WWW.PROMOREGALS.COM/

User access to the Content does not imply any obligation on the part of the Provider to monitor for the absence of viruses or other harmful computer elements that may have a damaging effect on the User's computer equipment. Consequently, the Provider will not be liable for any damage caused to the computer equipment of Users or third parties during access to the Content.

The Provider will not be liable for interruptions in electrical or telecommunications services that prevent users from using the services offered.

31. Applicable Law and Jurisdiction

These terms and conditions shall be governed by and construed in accordance with Spanish law in all matters not expressly provided for herein. The provider and the user agree to submit any dispute that may arise from the provision of the products or services covered by these terms and conditions to the courts of the user's domicile.

In the event that the user is domiciled outside of Spain, the provider and the user expressly waive any other jurisdiction, submitting to the Courts and Tribunals of the domicile of THE WEBSITE OWNER.

32. Dispute resolution and alternative methods

In accordance with current consumer legislation in Spain and the European Union, we inform our clients that, in case of conflict, they can resort to alternative dispute resolution mechanisms (ADR), which are impartial and extrajudicial.
